How is court fee calculated in India?

Court fee is calculated as a percentage of the claim amount (ad valorem) for money and property suits. For declaratory suits, injunctions, and other non-money reliefs, a fixed court fee applies. Rates differ for District Courts, High Courts, and the Supreme Court.

Is court fee refundable if my case is settled?

Yes. If the dispute is settled through a Lok Adalat or before judgment is passed, you are entitled to a full refund of the court fee paid under the Legal Services Authorities Act, 1987.

Can court fee be waived for poor litigants?
