Right to maintenance from children and grandchildren
Children and grandchildren (including adopted children and step-children) are legally bound to maintain parents and grandparents. Senior Citizen can file application before Maintenance Tribunal. Order within 90 days. MWPSCA 2007.
Right to maintenance up to Rs.10,000 per month (extendable by state)
Tribunal can award maintenance up to Rs.10,000 per month. Many states have enhanced this amount. Monthly maintenance from child, daughter-in-law, or legal heir who inherits property.
Right to reclaim property transferred to ungrateful children
If property is gifted to children on condition of maintenance and they fail to provide maintenance, Senior can apply to Tribunal to cancel the transfer. Property reverts within 90 days. MWPSCA 2007 Section 23.
Right to priority service in banks, hospitals, and government offices
Senior citizens (60+) are entitled to separate queues and priority service at banks, post offices, hospitals, and government offices. Failure to provide is a valid grievance. Many states have enacted rules.
Income tax benefits for seniors
No income tax: seniors (60-79 years) up to Rs.3 lakh; super seniors (80+) up to Rs.5 lakh. Higher deduction for medical insurance under Section 80D (Rs.50,000). Seniors above 75 with only pension and interest income: no filing needed.
Right to expedited court hearings
Pending cases involving senior citizens must be given priority listing by courts. High Courts have directives to fast-track senior citizen matters. Note this in your petition.
Right to free legal aid
Senior citizens are entitled to free legal services from Legal Services Authorities (Zila, State, NALSA) regardless of income. Covers all courts including High Court and Supreme Court.
Right against elder abuse and dedicated police cell
Physical and financial abuse of senior citizens is actionable under BNS. Senior Citizen Safety Cells exist in many state police departments. Helpline: 14567 (Elder Line, toll free). Cyber crime: 1930.
