Right to equality and non-discrimination
No person with disability can be discriminated against in employment, education, or access to public services. RPWD Act 2016 covers 21 categories of disabilities. Applies to both government and private sector.
Right to 4% reservation in government jobs
4% horizontal reservation in Central Government jobs (1% each for visual, hearing, locomotor, and other/multiple disabilities). State governments must also provide at least 4% reservation. RPWD Act 2016 Section 34.
Right to free and appropriate education up to 18
All children with benchmark disabilities (40%+ disability) are entitled to free and appropriate education including special educators, accessible classrooms, aids and appliances, and transport.
Right to a disability certificate
Disability certificate issued by the Chief Medical Officer or Government Medical Board. 40%+ benchmark disability entitles holder to all government concessions, reservations, and benefits.
Right to accessible infrastructure
All new public buildings, public transport vehicles, and websites of government bodies must be made accessible. Existing infrastructure has a mandatory accessibility compliance timeline. RPWD Act 2016 Sections 40-46.
Right to social security schemes
State governments must provide disability pension, assistive devices (ADIP scheme), scholarships, and vocational training. NHFDC provides loans for self-employment. Apply at District Social Welfare Office.
Right to guardianship with preservation of own rights
Limited guardianship model: a person with disability retains all legal rights and capacity. Guardian supports decision-making but cannot override the person's own choices. RPWD Act Chapter V.
Right to file complaint with State Commissioner
State Commissioner for Persons with Disabilities hears complaints of rights violations. Can award compensation and direct remedial action. Fine up to Rs.5 lakh (first time) and Rs.10 lakh (repeat violations).
